RELEASE, WAIVER of LIABILITY and ASSUMPTION OF RISK

WHEREAS, Eastern Market Pottery operates a pottery-making studio located at the Eastern Market, 225 Seventh Street SE, Washington, DC 20003; and

WHEREAS, the undersigned (“Participant”) desires to engage in pottery-making activities at Eastern Market Pottery;

NOW THEREFORE, for and in consideration of engaging in pottery making at Eastern Market Pottery, Participant hereby releases Eastern Market Pottery, its employees, officers, directors, successors, and assigns (“Releasees”) from all liability to the undersigned for any loss or damage to property or physical injury, whether caused by Releasees or otherwise that result, directly or indirectly from participating in pottery-making activities at Eastern Market Pottery. Participant further agrees to indemnify, save and hold Releasees harmless from any loss, liability, attorneys’ fees, damage, or costs that they (or any of them) may incur arising out of or related to engaging in pottery making at Eastern Market Pottery whether caused by the negligence of the Releasees or otherwise, and does hereby assume the risk of any such loss or damage.

Participant does further covenant and represent that Participant has read this document and voluntarily signed this Release, Waiver of Liability and Assumption of Risk.

This Agreement shall be governed by the laws of the District of Columbia and Participant and Eastern Market Pottery agree that any legal action relating to or arising out of this agreement shall be brought exclusively in the courts of competent jurisdiction in the District of Columbia.
